Govt servant can not insist to be retained at a post for two years/ High court

A Full bench of Jammu and Kashmir High court said ,” A government servant has no enforceable right to insist that he or she may be permitted to serve for two years at a station or a post  “. The full bench was comprised of chief justice N P Vasantha Kumar, justice B L Bhat and justice Hasnain Masoodi . The bench while deciding on two conflicting judgements about the transfers regulated by by state service rules said that ” A Government servant has no enforceable right to insist that he may be permitted to serve for two years at a post or station ” . The bench further said ,” the order has no statutory force or flavour which could make it enforceable by law “. The judgement has as such settled the civil service regulation providing for a minimum tenure of two years for purpose of transfer and the policy of transfer framed by the Govt in 2010.
